2) Changes to These Terms

We may update these Terms from time to time. The “Effective Date” will reflect the most recent version. By continuing to use the Services after changes are posted, you accept the updated Terms.

3) The Services (What We Provide)

Artist HQ may provide:

  • Informational content about our offerings (e.g., media management, content creation, strategy, website services)

  • Lead capture, inquiry forms, and booking tools

  • A client portal for onboarding, communication, file submission, project coordination, and deliverables

  • Purchases of digital goods, subscriptions, and/or service packages

We can modify, suspend, or discontinue any part of the Services at any time.

4) Eligibility

You must be at least 18 years old, or be accompanied by your legal guardian, to use the Services, create an account, or purchase anything through the Services. 

5) Accounts and Security

If you create an account:

  • You agree to provide accurate information and keep it updated.

  • You are responsible for maintaining the confidentiality of your login credentials.

  • You are responsible for the activity that occurs under your account.

We may suspend or terminate accounts to protect the Services or enforce these Terms.

6) Acceptable Use

You agree not to:

  • Use the Services for illegal activity

  • Upload or share content you don’t have rights to use

  • Harass, threaten, abuse, defame, or invade privacy

  • Attempt to hack, reverse engineer, disrupt, or overload the Services

  • Use automated scraping, bots, or data-mining tools without permission

  • Upload malware, spyware, or malicious code

  • Impersonate another person or misrepresent your affiliation

We can remove content, restrict access, or terminate accounts if we believe you violated these rules.

7) Your Content (Uploads, Submissions, and Permissions)

User Content” means anything you upload, submit, or provide through the Services (e.g., photos, videos, audio, brand assets, copy, logos, likeness, metadata, documents).

You represent and warrant:

  • You own the User Content or have all necessary rights, licenses, permissions, and releases to provide it.

  • Your User Content does not infringe copyright, trademark, privacy, publicity, or other rights.

  • If your content includes other people (faces, voices, performances), you have the necessary permissions/releases from them.

License you grant to us

You grant Artist HQ a non-exclusive, worldwide, royalty-free license to host, store, reproduce, modify (for formatting), process, transmit, and display your User Content solely to provide and improve the Services (including creating deliverables you requested, collaborating with contractors, and delivering files through third-party tools). This license ends when your content is deleted from our systems, except where retention is required for legal, backup, or dispute purposes.

We are not responsible for your content

You are fully responsible for User Content and how it’s used in the real world (including claims made in ads, accuracy of statements, and compliance with platform rules).

8) Intellectual Property (Our Stuff)

All content and materials on the Services—excluding User Content—are owned by Artist HQ or our licensors and are protected by copyright, trademark, and other laws. This includes text, design, layout, logos, graphics, templates, videos, and other assets (“Artist HQ Content”).

You may not copy, reproduce, sell, or redistribute Artist HQ Content without our written permission, except where clearly allowed (for example, downloadable resources we explicitly provide for that purpose).

No rights are granted except as expressly stated in these Terms.

9) Purchases, Subscriptions, and Billing

If the Services allow purchasing packages, subscriptions, or digital products:

  • Prices are shown at checkout and may change at any time.

  • You authorize us (and our payment processor) to charge your payment method for purchases and recurring charges (if subscription-based).

  • Taxes may apply depending on your location.

Renewals & cancellation

Subscriptions (if offered) renew automatically unless cancelled before the renewal date. Cancellation stops future renewals but does not automatically refund past charges unless required by law or stated in writing.

Refunds

Unless a written agreement says otherwise, all sales are final for digital products. Service refunds (if any) are handled based on the terms in your signed proposal, statement of work, or service agreement.

10) Third-Party Services and Links

We may use or integrate third-party services (e.g., payment processors, scheduling tools, file hosting, analytics, video hosting, social platforms). Your use of those services may be subject to their separate terms and privacy policies.

We are not responsible for third-party services, downtime, data handling, or content.

11) Confidentiality and Sensitive Materials

If you share confidential business info through the portal or during a project, we will use reasonable care to protect it, but no system is perfect. Do not upload highly sensitive information unless it’s necessary for your project.

If you need formal confidentiality protections, that belongs in a separate signed NDA.

12) Disclaimers

The Services are provided “as is” and “as available.” To the fullest extent permitted by law:

  • We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

  • We do not guarantee the Services will be error-free, uninterrupted, or perfectly secure.

  • We do not guarantee results (views, sales, followers, algorithm wins, brand deals, record deals, etc.). The internet is chaos. Beautiful, dumb chaos.

13) Limitation of Liability

To the fullest extent permitted by law, Artist HQ will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or business opportunities arising from your use of the Services.

Our total liability for any claim relating to the Services will not exceed the greater of:

  • the amount you paid us in the 3 months prior to the event giving rise to the claim, or

  • $100.

Some jurisdictions don’t allow certain limitations, so parts of this section may not apply to you.

14) Indemnification

You agree to defend, indemnify, and hold harmless Artist HQ and our team from claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of:

  • your User Content,

  • your misuse of the Services,

  • your breach of these Terms,

  • your violation of any law or third-party rights.

15) Termination

We may suspend or terminate your access to the Services at any time if we believe you violated these Terms or if necessary to protect the Services or others.

You may stop using the Services at any time. Sections that should logically survive termination (e.g., IP, disclaimers, limitation of liability, indemnification) will survive.

16) Governing Law

These Terms are governed by the laws of Tennessee, without regard to conflict of law rules. Venue for any dispute will be in Williamson County, TN, unless otherwise required by law.

17) Dispute Resolution

Before filing a claim, you agree to contact us at hello@artisthq.co and attempt to resolve the dispute informally.

18) Privacy
